We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should not assume registration of your requested domain name(s) until you have been notified that it has been registered. The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; ICANN in the case of .COM/NET/ORG and Nominet in the case of domain names ending with .UK you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name. We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute. We shall not release any domain to another provider unless full payment for that domain has been received by us. All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site and shall be due and payable in advance of our service provision. Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you. You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services. If you fail to pay any sums due to us as they become due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you. If you break any of these terms and conditions and you fail to correct the breach within seven (7) days following written notice from us specifying the breach, we may terminate this Agreement forthwith. If you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to terminate this Agreement forthwith. On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your Web Site and to remove all data located on it. We shall be entitled to delete all such data but we may, at our discretion, hold such data for such period as we may decide to allow you to collect it at your expense, subject to payment in full of any amounts withstanding and payable to us.
Affiliates may not mask, hide or modify the affiliate link. It must be used as displayed in the client area. You may not spam or advertise in areas or sections of websites that breach the rules of the displaying site. Doing so will result in the link being reported.
If you are dissatisfied with any aspect of our services, you are encouraged to contact our Support Department, who will make every reasonable effort to resolve the issue.
If the issue cannot be resolved to your satisfaction, you have the right to cancel your account. Please note that, as our web hosting plans include a free first month, no refund is available for this period.

All domain name registrations and transfers processed through Apex Managed Services are non-refundable. In the event that your hosting account is terminated due to a breach of our Acceptable Use Policy, Terms of Service, or for non-payment, and you hold a domain name with us that you wish to transfer to another provider, a £85.00, plus any additional taxes, administrative release fee will be payable prior to the initiation of the transfer. This fee is exclusive of any additional domain transfer charges imposed by registrars or third parties, for which you remain solely responsible. This policy does not affect your statutory rights.
Virtual Private Servers (VPS) and Dedicated Servers are non-refundable under all circumstances. No refunds will be issued in the event of termination of hosting or any other services as a result of a breach of our Acceptable Use Policy or any other violation of our Terms and Conditions. This policy does not affect your statutory rights under applicable law.
Refund Eligibility for Other Services For queries regarding eligibility for refunds relating to Other Services, Hardware, Software, Telecommunications, and Licensing, please contact our sales team at sales@apexmanaged.services prior to purchase or as soon as possible thereafter. Due to the varied nature of our service offerings, we are unable to provide a definitive list of refundable and non-refundable services in advance. Where a refund is permitted, any claim for such refund must be made within fourteen (14) days from the date on which the relevant service was first made live. Please note that web design services are strictly non-refundable under all circumstances. This refund policy is provided in addition to, and does not affect, your statutory rights under applicable consumer protection legislation.
Premium Linux & Wordpress Hosting, cPanel & DirectAdmin Shared Hosting Apex Managed Services is committed to providing a reliable and high-performing service and therefore offers a 99% uptime guarantee on all standard hosting services. This uptime percentage refers to the availability of our network and hosting infrastructure on a monthly basis. While we take all reasonable measures to maintain this level of service availability, a service credit of (1) month's hosting will be given if this falls below 95%. No refunds, or financial compensation will be provided in the event that actual uptime falls below the stated guarantee. This guarantee expressly excludes periods of planned or emergency maintenance, which may be necessary to maintain the integrity, security, or performance of the services provided. Planned maintenance will, where practicable, be notified in advance via email or via the client portal. Please note that Dedicated Servers and Virtual Private Servers (VPS) carry a 99% uptime however no service credits, refunds or financial compensation will be given for any fall in uptime, unless otherwise agreed in writing. You agree to comply fully with these Terms of Service, Acceptable Use Policies, and all associated rules, regulations, and policies of Apex Managed Services. Any breach of these Terms or related policies shall constitute grounds for immediate suspension or termination of your account at the sole discretion of Apex Managed Services. Suspension or termination may occur with or without notice.
No credits or refunds will be provided for periods of suspension. Apex Managed Services reserves the right to retain any prepaid fees as liquidated damages in the event of termination due to breach of these Terms.
You are responsible for maintaining the confidentiality of your account credentials. You agree to promptly notify Apex Managed Services of any unauthorized access to your account or any known or suspected breach of security.
Apex Managed Services does not routinely monitor content but will act on notifications of alleged copyright infringement in accordance with applicable law. Complaints must be directed to abuse@apexmanaged.services and include sufficient details for investigation. Upon valid notification, content may be removed or disabled pending resolution.
Use of the Service is at your sole risk. Apex Managed Services makes no representations or warranties regarding third-party content accessible via the Service. You agree to hold harmless Apex Managed Services, its employees, and affiliates from any liability arising from your use of the Service.
Should you use the Service for voice or telecommunications, you acknowledge that Apex Managed Services is not a telecommunications carrier and accepts no liability for such use, including connection quality or service interruptions.
You agree to indemnify Apex Managed Services for any damages, losses, or expenses arising out of your misuse of the Service, including costs incurred due to spamming, denial of service, or violation of intellectual property rights. Apex Managed Services may pursue legal remedies for recovery of such damages.
In no event shall Apex Managed Services be liable to you for any direct, indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service.

Apex Managed Services does not guarantee uninterrupted or error-free Service. Backup of your data is your sole responsibility unless otherwise stated in writing. Apex Managed Services accepts no liability for data loss.

By using our services, you accept full responsibility for managing the exposure and access to such content for yourself and any parties you are responsible for.
Apex Managed Services is committed to protecting the privacy and confidentiality of its subscribers. We will not disclose names, addresses, telephone numbers, email addresses, or any other personally identifiable information of any subscriber to any third party without the prior express consent of the subscriber.
Exceptions to this policy include disclosure as required by applicable law, regulation, or legal process, including but not limited to a valid court order, subpoena, or administrative directive. We may also disclose such information as is necessary for the proper provision and maintenance of the Service.

In the event of any dispute, claim, or controversy arising out of or in connection with your subscription to, or use of, the services provided by Apex Managed Services, which cannot be resolved amicably between the parties, such dispute shall be submitted to binding arbitration.
The arbitration shall be conducted in accordance with the laws of England and Wales. The language of the arbitration shall be English, and the venue shall be within the jurisdiction of England and Wales unless otherwise agreed by both parties in writing.
By subscribing to and using our services, you agree to waive your right to pursue any claims or disputes in court, including the right to a jury trial, except to the extent that applicable law provides otherwise.
These Terms and Conditions, together with all related policies and any contractual obligations between you and Apex Managed Services, shall be governed by, and construed in accordance with, the laws of England and Wales.
You agree that any disputes arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
All cancellation requests must be submitted through the Client Area associated with your account. To initiate cancellation, please navigate to the "My Services" section under your account profile. Locate the relevant service you wish to cancel and select the "Request Cancellation" option. You must then complete and submit the online cancellation form provided.
No other forms of cancellation will be accepted. Cancellations submitted by email, telephone, or live chat will not be valid. Requests made via a Support Ticket will be accepted.
Cancellation requests must be submitted before the generation of the invoice for the next billing cycle. Failure to submit your cancellation request prior to the due date of the next invoice will result in the full amount of the invoice becoming payable.
Please note that cancellation requests can only be submitted if the account has no outstanding or overdue invoices. All balances must be cleared prior to requesting cancellation.
Resellers are permitted to use their accounts solely for personal use or to provide services to their own clients. Under no circumstances are resellers allowed to host free accounts.
Apex Managed Services will transfer up to thirty (30) reseller accounts free of charge. Any additional account transfers beyond this limit will incur a fee of £1 per account, plus any applicable taxes.
Only one discount voucher may be applied per transaction. In the event that the order value is less than the value of the voucher, any remaining balance on the voucher shall be forfeited.
Discount vouchers are limited to one per customer and may be redeemed against the purchase of any Shared, Reseller, or Dedicated service offered by Apex Managed Services.
These Terms and Policies may be amended at any time by Apex Managed Services through the posting of the updated Terms and Policies in the Terms of Use section of the Service. Your continued use of the Service following such posting shall constitute your acceptance of the amended Terms and Policies.
